RMS-Wholesale is intended to supply cellular phone dealers, agents, wholesalers, and repair centers with core goods. Product should only be purchased by those who have repair capabilities. This site is not inented for consumer use or sales. Sales are accepted only from those businesses who can provide a valid business license or resale Certificate. Florida customers must supply a Resale Certificate or tax will be charged and is non-refundable. Visit our ebay store if you are a consumer looking for a replacement phone or phone in general. A valid business license is required for continual purchases from this website and should be updated every year.
Refunds
No refunds. All sales are final. See Returns/Warranty Terms information for warranty claim and processing guidelines.
International Orders
No refunds. All sales are final. Payment is to be paid in full including shipping costs via wire transfer. NO COD, NO Credit Card transactions for orders shipped outside of USA.
Returns/Warranty Terms
Product Warranty period is 30-days from date of invoice unless otherwise indicated per category or sales upgrade if applicable and excludes untested, repair stock, and any categories associated with no testing or failures.
All Returns must be pre-approved and assigned a valid RMA number prior to return. Any goods sent back without approval and a valid warranty return number will be subject to a 10% fee based off of individual value and will be subject to acceptable return conditions from category guarantees.
Returns are subject to repair first, credit to account second. If a successful repair is made, goods will be returned to buyer. Any unsuccessful repairs will be credited to buyer's account for future purchase.
Returns are only accepted for valid warranty claims on failed product per category description.
As an example, if a phone is purchased from "Tested Handset" category and is presented for defective charging port, the RMA will be declined. If phone from same category has a defective camera, the RMA will be accepted. Please read our product testing/conditions very carefully!
All paid upgrades take precedent over originating category. Example: A phone purchased from "Tested Handset" category has a paid upgrade for Full Test. Phone is presented for defective charging port. RMA is accepted.
ESN’s
ESN’s are NOT guaranteed to be “good” and may or may not be on a carrier’s lost/stolen/active blacklist. Requests for ESN numbers MUST be made prior to shipping goods for any desired purchase that includes phones with typical ESN issues, primarily, but not limited to Sprint, US Cellular, Verizon, and most CDMA providers. Shipments made without prior notification of the need for ESN numbers WILL NOT qualify for return/RMA. Please notify us when placing orders and we will gladly send a list of ESN numbers so you may contact the proper carrier to ensure that the goods may be activated. Upon receipt of said ESN numbers, buyer has 24 hours to respond or the complete order will be voided. Phones with validated ESN numbers shipped after notification buy the buyer that subsequently are reported as lost or stolen are not returnable. It is the buyer’s responsibility to discuss with the service provider why they were initially reported as good, only to arrive and be reported as lost/stolen when activation is attempted.
Refused Shipments
Any and all refused shipments by fault of buyer will be subject to a minimum 15% restocking fee. Any order refused and resent at the customer's request will have the restocking fee waived, however, reships will be subject to a $5 per box fee and original freight costs will be doubled.
Processing Time
All sales will be subject to a processing time not to exceed 72 hours or 3 days from date of order, whichever is greater. Selected shipping method is active only after the order is processed regardless of desired transit time.
Orders placed after 3pm EST are considered to be made for the following day. All listed time frames exclude weekends and are limited to M-F as ship/transit production times. Special accommodations can be made for weekly accumulation and consolidated shipments of multiple orders.
Please advise should orders need to be expedited and sent sooner than the standard 72 hr/3day time frame. A $20 service fee shall be added to all expedited requests.
Additional Fees
RMS Communications and http://www.rms-wholesale.com/ reserve the right to implement any fees without prior notice regarding any special request by customers. Pricing will be confirmed at time of sale via verbal and/or written agreement. Confirmation of said pricing is binding. Pricing and special conditions will be disclosed on final invoices and/or packing slips.
Product Conditions
General Condition(s)
All cellular phones, unless indicated otherwise by category or agreement, are handset only and do not include battery, battery door, or charger.
Phones may or may not need new case parts. RMS Wholesale lists and sells USED, TESTED handsets. All goods are sorted by model and ELECTRONIC functionality, not by physical condition. All goods are sorted by PASS/FAIL not by BROKEN/UNBROKEN in regards to physical condition.
As moisture wicks are not a true identifier of water damage, we do not fail for an activated moisture wick. Any obviously water damaged phones are failed regardless of electronic functionality and classified as repair stock.
Paid Upgrades
Paid upgrades are available for the inclusion of batteries and/or doors as well as cosmetics (physical condition) to prevent the receipt of “broken” phones regarding case parts. Full test upgrades are available for all categories except repair stock. As these upgrades involve further testing or handling, orders may be shorted due to final outcome of paid upgrade success. Click any product's picture or the "more info" text next to the item pictures. Nextel phones do not qualify for sales upgrades and will always be only Power-On, good LCD.
Freight Costs/Handling Charges
Freight Costs and all applicable charges associated with handling are LIVE with both FED EX and UPS services. All orders are subject to a $5.00 minimum handling charge.
Wholesale Category Definitions and Warranties
Tested Handsets - Handset only, tested and passed (where applicable) for:
1. Power on
2. Visible signal strength
3. Working LCD (inner and outer if applicable)
4. Working camera
As-is cosmetic condition. Handsets may or may not need case parts replaced. All handsets are used and will show typical signs of use. Paid upgrades are available for further testing and cosmetic guarantees.
Chargers are not available.
Battery and battery door may be available, but for an additional fee. See terms of use and Paid Upgrade options. Subject to availability. Battery sales are not permitted outside of USA if sent by Air. Orders via freight/ship are acceptable.
Paid upgrades are subject to availability and may or may not be available. Orders will be reduced based off of actual quantities available.
30-day warranty. Handsets may have other functional issues and should be purchased only by those capable of repairs if needed. Acceptable returns are for failures regarding the listed tests above. All RMA's must be pre-approved prior to sending in for processing. RMA's submitted for failures other than what tests are listed above will immediately be declined. See warranty section of our Terms of Use for full disclosure.
Repair Stock - Handset only, tested and failedfor one or all functional tests. As-is electronic and cosmetic condition. Handsets do not work and need to be repaired by a qualified technician. RMS DOES NOT attempt any repair and simply classifies as "non-working" goods. No warranty, no return.
Untested Handsets - All are handset alone, no battery, no door, no charger, and no testing has been performed. Goods are simply received and sorted by carrier, manufacturer, and model. No warranty, no return. Full test is available as a paid upgrade.
Carrier Return Kits - Carrier Return. May be in either a generic white or original box. No guarantee which. Complete with phone and aftermarket or OEM battery, charger. May or may not have a manual. 30-day warranty. May be locked to a specific service provider. Purchaser MUST notify their sales representative if a specific carrier compatible phone is needed. Returns will not be accepted if we are not notified and a phone is received not compatible with your carrier.
$1.00 Deals - Periodically we will have liquidation handsets just to move qty. Normal conditions per item descriptions apply. Due to the low price, no returns will be accepted for $1.00 deals or items in any category listed for $1.00. See item description for product quality. Click the picture for paid upgrades. Full test and cosmetic guarantee do qualify for warranty return and overrule general return policy for $1.00 deals.
Limitation of Liability
RMS Communications, Inc. shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if RMS Communications, Inc. has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Typographical Errors
In the event that a RMS Communications, Inc. product is mistakenly listed at an incorrect price, incorrect quantities, or any error affecting original terms of sale RMS Communications, Inc. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. RMS Communications, Inc. reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, RMS Communications, Inc. shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by RMS Communications, Inc. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.
